La Montagna is committed to transparency and to upholding the right of access to information under the Promotion of Access to Information Act, 2 of 2000 (PAIA).

About PAIA

PAIA gives effect to the constitutional right of access to information. It allows any person to request access to records held by a private body where that record is required to exercise or protect a right. This page sets out how to make such a request to La Montagna and who to contact.

PAIA works alongside the Protection of Personal Information Act (POPIA), which governs how we collect and protect personal information. Compliance with one does not replace our obligations under the other. See our Privacy Policy for how we handle personal information.

How to request access

  1. Complete the prescribed Form 02 — Request for Access to Record of Private Body, available from the Information Regulator (linked below).
  2. Identify the record you are requesting as clearly as possible, and state the right you are seeking to exercise or protect and why the record is required.
  3. Provide your contact details and the form of access preferred (for example, a copy or inspection).
  4. Submit the completed form to the Information Officer using the contact details above.
  5. We will respond within 30 days of receiving a valid request. This period may be extended in the circumstances permitted by PAIA, in which case we will notify you.

Fees

A request fee and access fees may be payable as prescribed by the PAIA regulations. Where a fee applies, we will notify you of the amount, and access to the record is provided once the applicable fee has been paid.

Grounds for refusal

Access to a record may be refused on the grounds set out in PAIA — for example, to protect the privacy of a third party, commercially sensitive information, or information held in confidence. Where we refuse a request, we will provide reasons as required by the Act.

If you are not satisfied

If you are aggrieved by a decision in response to your request, you may lodge a complaint with the Information Regulator, or apply to a competent court for appropriate relief.
