La Montagna respects your privacy. This policy explains how we collect, use, share and protect personal information in terms of the Protection of Personal Information Act, 4 of 2013 (POPIA).
1. Who we are
La Montagna (“La Montagna”, “we”, “us”) is the responsible party for the personal information described in this policy. We are a digital agency providing bespoke web development and full-stack digital marketing services.
Our Information Officer, Domenico Cosentino, is responsible for ensuring our compliance with POPIA. Contact details are set out in the final section of this policy.
2. Scope
This policy applies to personal information we collect through our website, through our communications with you, and in the course of providing our services. Where we process personal information on behalf of a client — for example while building or managing a client's website — we act as an operator, and that processing is governed by our agreement with the client and their own privacy policy.

Depending on how you interact with us, we may collect:
- Identity and contact information — your name, business name, email address, telephone number and postal address.
- Project and business information — details you share with us about your requirements, brand, and the services you ask us to provide.
- Billing information — information needed to invoice you and process payments.
- Correspondence — the content of enquiries, messages and other communications between us.
- Technical and usage information — your IP address, browser and device type, and how you use our website, collected automatically (see Cookies and Analytics below).
4. How we collect information
- Directly from you — when you contact us, request a quote, engage our services, or correspond with us.
- Automatically — through cookies and similar technologies when you use our website.
- From third parties — such as referrals, or publicly available business sources, where relevant.
5. Why we use your information
We process personal information only where POPIA permits it — including where it is necessary to perform a contract with you, to comply with a legal obligation, for our legitimate interests, or with your consent. We use it to:
- respond to your enquiries and provide quotes;
- deliver, manage and support the services you engage us for;
- invoice you and process payments;
- communicate with you about your projects and our services;
- send marketing communications where you have consented or are otherwise permitted by law (you may opt out at any time);
- maintain, secure and improve our website; and
- comply with our legal and regulatory obligations.
6. Cookies and analytics
Our website uses cookies and similar technologies to make the site work, remember your preferences, and understand how it is used so we can improve it. We may use analytics tools that collect aggregated, usage-level information.

7. Sharing your information
We do not sell your personal information. We may share it with:
- Service providers (operators) — such as hosting, email, payment, analytics and accounting providers who process information on our behalf under appropriate safeguards;

- A successor — in connection with a business sale or reorganisation.
8. Cross-border transfers
Some of our service providers store or process information outside South Africa (for example, cloud hosting and software services). Where personal information is transferred across borders, we take reasonable steps to ensure it is protected in line with the requirements of POPIA.
9. How we protect your information
We implement reasonable technical and organisational measures to protect personal information against loss, unauthorised access, and misuse — including access controls, secure hosting, and appropriate use of encryption. If a security compromise affecting your personal information occurs, we will notify you and the Information Regulator as required by POPIA.
10. How long we keep it
We keep personal information only for as long as necessary for the purposes set out in this policy, or as required to meet legal, tax and accounting obligations. When it is no longer needed, we securely delete or de-identify it.
11. Your rights
Subject to POPIA, you have the right to:
- request access to the personal information we hold about you;
- request that we correct or update inaccurate or incomplete information;
- request that we delete or destroy your information where appropriate;
- object to the processing of your information in certain circumstances;
- withdraw consent where we rely on it (this does not affect prior processing); and
- lodge a complaint with the Information Regulator.

12. Children's information
Our services are directed at businesses and are not intended for children. We do not knowingly collect the personal information of children without the consent of a competent person.
